Understanding Parental Liability in North Dakota
In North Dakota, parents, legal guardians, or foster parents play a significant role in the process of a minor obtaining a driver's license. According to the North Dakota Century Code, these individuals are legally liable for any negligence caused by the minor when driving a vehicle. This liability extends to cover damages resulting from accidents, injuries, or fatalities caused by the minor's actions behind the wheel.
Revoke/Cancellation of Sponsorship
However, there are provisions in place to address parental liability in the event of negligence by the minor driver. The person who signed as the sponsor for the minor's driver's permit or license holds the authority to revoke or cancel this sponsorship. By doing so, they effectively remove their liability for any future actions of the minor while driving.
Process for Revocation and Reissuance
If the sponsorship is revoked, the minor's permit or license will be canceled, and the liability will be removed from the parent, legal guardian, or foster parent. In the case of a minor under the age of 18, they will need to have another parent, legal guardian, or foster parent sign as the sponsor to reissue the permit or license. Alternatively, once the minor turns 18, they can obtain their license or permit without the need for parental sponsorship.
